Bank Records as Evidence in Indian Courts

From 1 October 2026 India's courts will read bank records under a law written for cloud storage rather than ledgers. The Bankers' Books Evidence Act, 2026, which the President assented to on 13 August 2026, takes over from an Act of 1891: it treats records kept in physical, electronic, digital, virtual and cloud form alike, standardises the certificate a bank attaches to them, and tells a court to write down a special cause before it summons a bank officer in a case the bank is not part of.

Dates the switch in India's law on bank records as evidence: the Bankers' Books Evidence Act, 2026 starts on 1 October 2026 and the Act of 1891 goes. The new law recognises electronic, digital and cloud records, standardises the bank's certificate, and makes a court record a special cause before it summons a bank officer in a case the bank is not party to.
